Chapter I – General Provisions
Article 1 – Scope of the Policy
1.1. This Policy establishes the conditions for the purchase of digital services offered through the Platform, the payment methods, the issuance of fiscal documents, as well as the conditions under which refunds may be granted.
1.2. The Policy supplements the Terms and Conditions and the Privacy Policy.
Article 2 – Purchased Service
By making the payment, the user purchases access to a digital service consisting of:
- access to an online simulation for the assessment of professional knowledge regarding Code 95;
- the right to take up to 3 attempts for the purchased test;
- display of the score obtained after each attempt.
The service does not represent an official exam and does not lead to the issuance of a certificate or attestation recognized by the authorities.
Article 3 – Price of the service
The standard price for access to a simulation is 120 EUR, unless another offer is displayed on the Platform valid at the time of purchase.
The prices displayed include or exclude VAT depending on the applicable tax legislation and will be clearly presented before the order is completed.
Article 4 – Payment methods
The Platform may accept, as appropriate:
- bank cards;
- other electronic payment methods displayed at the time of purchase.
Payments are processed through an authorized payment service provider.
The Operator does not store complete bank card data.
Article 5 – Payment confirmation
After confirming the payment:
- the service will be activated automatically or within a reasonable period;
- the user will receive confirmation of the purchase by e-mail;
- access to the simulation will be available in the user’s account.
Chapter II – Invoicing
Article 6 – Issuance of the invoice
The tax invoice will be issued based on the information provided by the user during the ordering process.
The user is obliged to verify the accuracy of the data entered.
Article 7 – Correction of billing data
Requests for correction of billing data will be analyzed to the extent permitted by applicable tax legislation
Chapter III – Right of withdrawal and refunds
Article 8 – Withdrawal before activation of the service
If access to the digital service has not yet been activated and the user benefits from a legal right of withdrawal, the request will be analyzed in accordance with applicable law.
Article 9 – Start of service execution
The digital service begins when the user is granted access to the purchased simulation.
Upon completion of the order, the user will expressly confirm that:
- requests the immediate start of the provision of the digital service; and
- has taken note of the effects of this request on the right of withdrawal, to the extent provided for by applicable law.
Article 10 – Refunds
Refunds may be granted, on a case-by-case basis, including in the following situations:
- the payment was collected in error;
- the user was charged twice for the same order;
- the service could not be provided for reasons attributable to the Operator;
- other situations in which the law requires the granting of a refund.
Refunds will not be granted solely because the user: - did not obtain the desired score;
- did not pass a subsequent official exam;
- changed his/her opinion after the digital service was provided, to the extent permitted by law.
Article 11 – Refund procedure
Refund requests are sent to the email address indicated on the Platform and must include:
- the user’s name;
- the email address associated with the account;
- the order or transaction identifier;
- the reason for the request;
- supporting documents, if applicable.
The Operator will analyze the request and provide a response within a reasonable time.
Article 12 – Refund method
If the refund is approved, it will usually be made using the same payment method used for the purchase, unless the parties agree otherwise or the law provides for another method.
Chapter IV – Fraud and suspicious transactions
Article 13 – Verification of transactions
The Operator may temporarily suspend the activation of the service if there are reasonable indications regarding:
- fraudulent use of a payment instrument;
- attempted fraud;
- violation of the Terms and Conditions.
Article 14 – Chargebacks
In the event of a chargeback procedure being initiated, the Operator may suspend access to the service until the situation is clarified, in compliance with the user’s rights and applicable procedures.
